Red Flags in Legal Bills is a more advanced course in legal bill auditing. Call it Legal Bill Audit 201. This book takes a more in-depth look behind some of the common and not-so-common billing issues to see what important warning signals attorneys may be inadvertently sending.

As explained in the book, observing an isolated issue in a legal bill can, but does not always, raise a red flag. But observing the same issue multiple times in a legal bill may be more of a warning that triggers the red flag. These red flags are signals that raise a cause for concern about something beyond the billing issue itself. That something may otherwise go undetected but for the signal the red flag is sending.

So just what kind of things can red flags signal?

Some red flags can signal that the lawyer is trying to deceive the client in his billing and possibly in other areas as well. Or certain red flags may indicate that the lawyer lacks the experience or the competence needed to be able to handle the matter to a successful conclusion. And some red flags may indicate that the lawyer lacks adequate staff to cost-effectively handle the matter or that the attorney is just not that interested in helping to hold down legal costs.

As explained in the book, far better to notice and to check out these red flag issues early on as they occur rather than wait till the end when faced with an unsatisfactory result or significantly more legal expense than originally anticipated.

John Conlon has audited legal fees and costs for attorneys, corporations, state and local governments and quasi-governmental units, and also for individuals in thousands of cases and other legal matters throughout the U.S. He has also audited legal bills in Puerto Rico, Australia, Canada, and the United Kingdom.

He has been asked to audit legal bills in all types of cases including complex cases such as class action and patent and trademark infringement cases, bankruptcies, employment law matters, environmental matters, wrongful death, defamation, sexual molestation, family relations, and even criminal law matters to name but a few.

Mr. Conlon also has trained attorneys and corporate employees in appropriate legal bill review techniques. He has also been called upon by corporations and state governments to audit their legal bill-paying units for accuracy. In addition, he has served as an expert witness or has provided expert opinions on both fee billing and ethical issues at the state and federal levels.
Possessing a solid background and an expertise in the field of legal ethics, Mr. Conlon is the only attorney fee bill auditor in the U.S. to have served as a Chair of a state bar association Legal Ethics Committee. Having an expertise in the field of ethics is of vital importance in reviewing fee bills as the ABA Rules of Professional Responsibility (RPC) and case law interpreting the RPC overarch and control all issues related to attorney fee billing. In addition to being a former Chair of the Indiana State Bar Association’s (ISBA) Committees on Legal Ethics and the Unauthorized Practice of Law, he was also a founding member of the ISBA Legal Fee Bill Dispute Committee. He also served as a longtime member of the Indiana Legal Ethics Hotline where he advised attorneys on legal ethics issues including fee billing issues.

As a practicing attorney, John provided legal counsel and expert opinions in cases involving legal billing disputes, legal ethics, and attorney malpractice. Utilizing his legal ethics background, John has been able to provide expert opinions on whether attorneys have complied with the ethical requirements of the legal profession when it comes to billing for fees and costs to either support or oppose requested fees.

Mr. Conlon has been a featured speaker at local and national seminars on legal ethics and fee billing. In addition, he has written articles on legal ethics and attorney fee billing issues.
