Overview

Few lawyers see anything wrong with the way they are billing their clients. But, as set out in the book, not only do clients but many legal ethics experts and bar association leaders think that lawyer overbilling has been and continues to be a major problem.

"Overbilling" can refer to any type of billing irregularity ranging from simple unintentional math errors to outright fraud and everything in between. But whether it is unintentional or intentional, there are ways to go about detecting lawyer overbilling. And that is what this book is all about.

The book details how to spot and deal with common billing issues. But the basic purpose of this book is not to focus on particular billing issues. Rather, the real purpose is to provide the basic methodology to use in auditing any legal bill. For if a client understands the basic methodology involved in how to go about auditing legal bills, then she will know how to effectively deal with any type of billing issue encountered.

The author calls this book "Legal Bill Review 101." And while this book was written primarily for the benefit of non-lawyers, it is believed that even lawyers will find this book to be of value, for over the years, the author has worked with a number of lawyers to help them sort out the legal fees of clients who come to them because they have questions about fees charged by another lawyer.

About the Author

John Conlon has audited legal fees and costs for attorneys, corporations, state and local governments and quasi-governmental units, and for individuals in thousands of cases and other legal matters throughout the United States, Puerto Rico, Australia, Canada, and the United Kingdom. He has been asked to audit legal bills in all types of cases, including complex cases such as class action and patent and trademark infringement cases, bankruptcies, employment law matters, environmental matters, wrongful death, defamation, sexual molestation, family relations, and even criminal law matters, to name but a few.

Mr. Conlon also has trained attorneys and corporate employees in appropriate legal bill review techniques. He has also been called on by corporations and state governments to audit their legal bill-paying units for accuracy. In addition, he has served as an expert witness or has provided expert opinions on both fee billing and ethical issues at the state and federal levels.

Possessing a solid background and expertise in the field of legal ethics, Mr. Conlon is the only attorney fee bill auditor in the United States to have served as a Chair of a state bar association Legal Ethics Committee. Having an expertise in the field of ethics is of vital importance in reviewing fee bills as the ABA Rules of Professional Conduct (RPC) and case law interpreting the RPC overarch and control all issues related to attorney fee billing. In addition to being a former Chair of the Indiana State Bar Association’s (ISBA) Committees on Legal Ethics and the Unauthorized Practice of Law, he was also a founding member of the ISBA Legal Fee Bill Dispute Committee. He also served as a longtime member of the Indiana Legal Ethics Hotline where he advised attorneys on legal ethics issues, including fee billing issues.

As a practicing attorney, Mr. Conlon provided legal counsel and expert opinions in cases involving legal billing disputes, legal ethics, and attorney malpractice. Utilizing his legal ethics background, he has been able to provide expert opinions on whether attorneys have complied with the ethical requirements of the legal profession when it comes to billing for fees and costs to either support or oppose requested fees.

Mr. Conlon has been a featured speaker at seminars on legal ethics and on fee billing at local and national seminars. In addition, he has written articles on various legal ethics subjects, including attorney fee billing.
