Overview

Taking your child custody case to trial should be the last alternative to resolving the dispute with your ex. Why? Because judges are unpredictable. Although the system is supposed to protect the best interests of your children, oftentimes it fails. You and the other parent, as parties to your child custody lawsuit, are the individuals best suited to decide the fate of your children and your family.

Unfortunately, most people who are embattled in child custody disputes forget they do have options that do not involve taking their cases to trial. Going to Trial is Like Gambling in Las Vegas explores alternatives to the family law courtroom, some of which are not difficult to execute. The book not only covers common sense options to a child custody trial, but it delves into lesser-known strategies such as collaborative law and arbitration, as well. By book's end, you will have gained a working understanding of the array of case settlement alternatives that do not include taking the case to a contested child custody hearing.

Author Bio

Wendy Hernandez is a Notre Dame–graduated lawyer and a courtroom warrior. She has tried over 1,000 cases in front of juries and judges during her twenty-three year legal career. Over the last twenty years of having her own law firm, Wendy has practiced family law almost exclusively. Over this period, Wendy has gathered highly classified intelligence about the deepest, darkest secrets of the about-to-be (or already) uncoupled person; she has literally interviewed thousands of clients who are on the verge of being catapulted to the dark, scary underworld known as family court.

Over her years of practice, Wendy has litigated multiple cases against unrepresented individuals. Wendy has observed these people crash and burn in the courtroom simply because they lacked the know-how to give her a run for her money in front of the big guy—the judge. Being a big fan of fairness in the law, Wendy created Command the Courtroom, an unexpectedly successful YouTube channel in which Wendy publishes several videos a month designed to help self-represented people navigate choppy legal waters. For the person wanting to dive more deeply into the ocean of family law self-representation, Wendy has created a series of in-depth online programs and resources under the Command the Courtroom umbrella.

For the person wanting to dive more deeply into the ocean of family law self-representation, Wendy has created a series of in-depth online programs and resources under the Command the Courtroom umbrella.

Prior to creating the Command the Courtroom brand, Wendy previously produced and hosted a podcast, The Family Law Insider, in which she interviewed authorities who might help make a person’s family court journey less painful. A sampling of those experts included psychotherapists, counselors, life coaches, sex therapists, family court judges, improv experts and financial, domestic violence, and lifestyle ninjas.

For approximately five years, Wendy served as a judge pro tem for the Maricopa County Superior Court, in which she presided over court-mandated settlement conferences to assist parties in case resolution. Wendy has been a regular presenter at Father Matters, a Phoenix non-profit devoted to “fathers mentoring fathers.” She has appeared as a guest on The Kick Ass Dad Podcast, the Vance Simms Show, the Skyler Irvine Show, and the Aftershock Online podcast. Wendy has been featured as a Lifehack author, was recently interviewed as part of The Emotional Abuse Recovery and Resilience Summit, and was a presenter on the “Equitable Division of Community Property” at the Southwest Divorce Conference.
