Overview

The O-1B visa is a subcategory of the O-1 visa, which is for "individuals with Extraordinary Ability or Achievement." What makes the O-1B visa—which is for artists and people working in film and television—unique is its flexibility. While other visas have strict or rigid requirements, the O-1B is more fluid. Recognizing that the arts span a wide array of disciplines, USCIS has minimal definitions and broad evidentiary requirements. This is advantageous because it enables artists from diverse disciplines to apply to work in the United States. But it can also be challenging because that same flexibility can lead to a less-than-clear process.

My goal is to make it easier for you to navigate the O-1B process. While I'm not providing formal legal advice in this book, I do offer an overview of the process and illustrate its twists and turns with examples drawn from my own experiences as an immigration attorney.

About the Author

A partner at New Jersey’s Meyner and Landis, LLP, Lin Walker focuses on employment- and family-based immigration law. For more than twenty years, she has represented individuals of extraordinary ability in the arts, sciences, and business, helping them bring their talents to the U.S. In addition to representing individuals of extraordinary ability seeking nonimmigrant and immigrant visa classifications, her practice also includes preparing and filing various employment-based petitions ranging from H-1Bs, L-1s, and TNs to Outstanding Researchers and Professors, Multinational Managers and Executives, and National Interest Waivers.

With O-1B visas, Lin focuses on the client as an individual and an artist. She helps her clients refine their message and navigate the sometimes-challenging road to getting a visa to bring their craft to the United States. One of the best parts of her job is meeting artists from around the world and learning about their art.
